We respect the privacy of our customers. This Privacy Policy explains our processing practices as they apply to our PartnerUp Coaching Program (the “Program”). Please take a moment to read this document to learn more about how we collect, use, and otherwise handle your Personal Data, as well as the choices and rights you have regarding how we do so.

References to "Side," "we," "our," or "us" in this Privacy Policy refer to Side, Inc. and the applicable Side affiliate(s) involved in our data processing activities and as connected to our PartnerUp Coaching Program. This Privacy Policy sets out the essential details relating to your Personal Data relationships with Side as a coachee in the Program.

  1. What information do we collect and what do we do with it?

When you enroll as a coachee in the Program through this site, as part of the enrolling process, we collect the Personal Data you give us, such as your name, email address, phone number, payment information, and/or company name. We also collect Personal Data relating to your engagement and/or purchase of the products and courses offered through the Program. In addition, please note that we may create audio and visual recordings of coaching sessions and courses in which you participate for reasonable business purposes, as further discussed below.

By providing us with your Personal Data to become a coachee in the Program, making a purchase, and/or participating in a course, you are consenting to our collection and use of your Personal Data. 

We use your Personal Data to: 

  • Deliver the contracted services and allow access to the products and courses in the Program;

  • Send communications to you about:

    • The Program and related courses and products

    • Registration and enrollment in the Program

    • Course content, progress, changes, and other updates

    • Our services and offerings

    • Event announcements

    • Promotional offers and surveys

  • Process payments for courses and products purchased through the Program; 

  • Provide customer support in connection with products and courses in the Program;

  • Carry out market research to understand how to improve the Program and related products and courses, and their delivery;

  • Generate sales leads and increase our market share; 

  • Advertise and market our products and services;

  • Manage our site to maintain and deliver the contracted functionality and services;

  • Prevent fraud and other prohibited or illegal activities;

  • Analyze user usage of the Program and related courses and products in order to train staff and coaches, and to improve the user experience and maximize usage of our products and services;

  • Protect the security or integrity of the site, the Program, our business or our products and services; and/or

  • Otherwise, as disclosed to you at the point of collection or as required or permitted by law.

In addition, we may collect cookies and use web analysis and tracking tools to customize our site content for you as an individual. If you are using one of the common Internet web browsers, you can set up your browser to either let you know when you receive a cookie or to deny cookie access to your computer.

  1. How do we share the information we collect?

In general, the third-party providers used by us will only collect, use and disclose Personal Data to the extent necessary to allow them to perform the services they provide to us.

We work with industry-leading coaches to provide you with the courses and products in the Program. The coaches will have access to your Personal Data as collected through our site and/or other means and only as reasonably necessary to perform the contracted tasks on our behalf. This may include using the Personal Data to communicate with coachees, improve courses and products, and provision or deprovision coachees. 

We may also share your Personal Data with third parties for the purposes of providing ancillary services, including, but not limited to, marketing our products and services via cross-context behavioral advertising, or running our promotions. Please submit a request to opt-out of the sharing of your Personal Data by utilizing the Do Not Sell or Share My Personal Data link at the bottom of our www.side.com website. 

Please note that we will disclose your Personal Data to third parties only as outlined in this Privacy Policy. Except as otherwise provided herein, we do not sell, rent, barter, share or otherwise disclose Personal Data, such as names, email addresses, mailing addresses or phone numbers, so that third-party advertisers may send you their advertisements or other solicitations.

In addition, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Data will be handled by these providers.

  1. Links to Third Parties

This site may contain links to websites maintained by third parties. If you submit Personal Data to any of those sites, your information is governed by their privacy policies. We encourage you to read the privacy policy posted at those websites carefully.

Once you leave our Program site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our PartnerUp Coaching Terms of Use.

  1. Disclosure

It is possible that we may need to disclose Personal Data when required by law, subpoena or other legal processes as identified in the applicable legislation. 

We attempt to notify our customers about legal demands for their Personal Data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency.


  1. Thinkific

Our Program and site is hosted by Thinkific Labs Inc. (“Thinkific”). They provide us with the online course creation platform that allows us to sell our products and services to you.

Your Personal Data is stored through Thinkific’s data storage, databases and the general Thinkific application. They store your data on a secure server behind a firewall.

Payment:

If you make a purchase on our site, we use the third-party payment processor Stripe. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our site and related courses and its service providers.

  1. Security

To protect your Personal Data, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

We provide the same Program to all of our customers nationwide. As such, we offer the following rights to all individuals regardless of their location or applicable privacy regulations.

For Personal Data we hold about you, you can:

  • Access your Personal Data or request a copy.

You have the right to obtain information about what Personal Data we process about you or to obtain a copy of your Personal Data. 

If you have provided Personal Data to us, you may contact us to obtain an outline of what information we have about you or a copy of the information. 

  • You have the right to be notified of what Personal Data we collect about you and how we use it, disclose it and protect it.

This Privacy Policy describes what Personal Data we collect and our privacy practices. We may also have additional privacy notices and statements available to you at the point of providing information to us directly.

  • Change or correct your Personal Data.

You have the right to update or correct your Personal Data or ask us to do it on your behalf. 

  • Delete or erase your Personal Data.

You have the right to request the deletion of your Personal Data at any time. We will communicate back to you within reasonable timelines the result of your request. We may not be able to delete or erase your Personal Data, but we will inform you of these reasons and any further actions available to you.

  • Object to the processing of your Personal Data.

You have the right to object to our processing of your Personal Data for direct marketing purposes. This means that we will stop using your Personal Data for these purposes.

  • Ask us to restrict the processing of your Personal Data.

You may have the right to ask us to limit the way that we use your Personal Data. 

  • Export your Personal Data.

You have the right to request that we export to you in a machine-readable format all of the Personal Data we have about you.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If our Program or business is acquired or merged with another company, your Personal Data may be transferred to the new owners so that we may continue to sell products to you.
